In UDP Campaign Manager's Trial


·         Defence Counsel Says Exhibit D3 is Made Up, Superintendent Mendy Disagrees

Banjul, The Gambia (TNBES) In the ongoing trial of the UDP Campaigm manager, the 4th prosecution witness on Tuesday tendered the letter that showed that APRC were onec denied permit to hold a rally.
However, the Defense counsel, Ousainou Darboe told the 4th witness that the letter is made up but Superintendent Mendy denied it under cross examination.
Darboe challenged him to produce an application made by APRC and to show where APRC has been rejected, the witness produce only one dated 23rd August 2001 but the rally took place on the 17th August, 2001.
Darboe ask why they did not reject the application before the rally, the prosecution witness said he did not know. Darboe then tendered the letter as an exhibit without any objection from the prosecutor; it was marked as Exhibit D3.
He put it to Mendy that the Exhibit D3 is made up, which the prosecution witness denied. The witness also provided the unapproved application send by the minority leader of the National Assembly to the IGP and the counsel tender it as an exhibit without any objection from the prosecutor and marked as exhibit D2.
Ousainou asked whether the Exhibit D2 was approved, Mendy said that it was not approved. The defence counsel further asked why the application of the opposition was not approve, he he said he did not know.
The defence counsel then put it to him that the application made by APRC was not from the campaign manager of APRC but was from the small ward which is ‘Takuligaye’ youths, which the witness (Superintendent Mendy) admitted.
The case has been adjourned till 2nd February, 2010. VOL:2 ISSN:47
