Ex-IGP faces fresh charges for robbery


·         The Director of Public Prosecutions at the Attorney-General's Chambers, Richard N Chenge, has filed a 17-count charge against the former Inspector General of Police, Ensa Badjie, and three others namely, Omar
Jahateh a police officer, CSP Ali Ceesay, a prison officer, and one Kemeseng Kolley.

·         The various counts range from conspiracy to commit felony, robbery with violence, receiving stolen property, aiding or abetting robbery, conspiracy to commit misdemeanour, aiding prisoner to escape, official corruption,
conspiracy to defeat justice and interference with witnesses, deceiving witnesses, offences relating to judicial proceeding, to using criminal charms, among others.
·         The accused persons are expected to appear before Justice Joseph Ikpala of the Special Criminal Court in Banjul on Friday, according to judicial sources.

The Honourable Court is informed by the Attorney General on behalf of the state that Ensa Badjie, CSP Ali Ceesay, Kemeseng Colley and Omar
Jahateh are charged with the following offences.
·         COUNT ONE
·         STATEMENT OF OFFENCE
·         Conspiracy to commit felony Contrary to Section 368 of the Criminal Code Cap 10 Vol III Laws of The Gambia 1990.
·         PARTICULARS OF OFFENCE
·         Ensa Badjie sometime in the year 2004 at Dippa kunda and other places in the Republic of The Gambia within the jurisdiction of this Honourable court
conspired with Soriba Condeh, Omar Touray, Yusupha Baldeh, Saikou
Touray and Bunkiling to commit felony to wit: robbery with violence and
thereby committed an offence.
·         COUNT TWO
·         STATEMENT OF OFFENCE
·         Robbery with violence contrary to section 272 and Punishable under Section 273 read together with Section 23 (d) of the Criminal Code Cap 10 Volume
III Laws of The Gambia 1990.
·         PARTICULARS OF OFFENCE
·         Ensa Badjie in the year 2004 at Dippa kunda and other places in the Gambia within the jurisdiction of this Honourable Court did commit an offence
to wit: procured Soriba Condeh, Omar Touray, Yusupha Baldeh, Saikou
Touray and Bunkiling to break into and rob a shop at Dippa Kunda and
gave him (Ensa Badjie) three cartons of Piccadilly cigarettes out of
the fifteen cartons they stole from the said shop and thereby committed
an offence.

·         STATEMENT OF OFFENCE
·         Receiving stolen property contrary to Section 297(1) of the Criminal Code Cap 10 Vol.111 Laws of The Gambia 1990.
·         PARTICULARS OF OFFENCE
·         Ensa Badjie in the year 2004 at Dippa kunda in the Republic of The Gambia within the jurisdiction of this Honourable court received three cartons
of Piccadilly cigarettes from Soriba Condeh knowing same to have been
obtained through robbery and thereby committed an offence.
·         COUNT FOUR
·         STATEMENT OF OFFENCE
·         Conspiracy to commit felony Contrary to Section 368 of the Criminal Code Cap 10 Volume Ill Laws of The Gambia 1990.
·         PARTICULARS OF OFFENCE

conspired with Soriba Condeh, Mohammed Camara (alias Langman), lbrahima
Souma, Lamin Drammeh (alias mino)and Yusupha Baldeh to commit felony to
wit: robbery with violence and thereby committed an offence.

·         Robbery with violence contrary to section 272 and Punishable under Section 273 read together with Section 23 (d) of the Criminal Code Cap 10 Volume
Ill Laws of The Gambia 1990.
·         PARTICULARS OF OFFENCE
·         Ensa Badjie sometime in the year 2007 at Dippa kunda and other places in the Gambia within the jurisdiction of this Honourable Court did commit an
offence to wit: procured Soriba Condeh, Mohammed Camara (alias
Langman), Ibrahima Souma, Lamin Drammeh (alias mino) and Yusupha Baldeh
to break into and rob a Lebanese shop at Saffiedeen in London corner
during which they stole 500, 000. 00 Dalasis and gave him (Ensa Badjie)
three hundred thousand Dalasis out of the said amount and thereby
committed an offence.

·         STATEMENT OF OFFENCE
·         Receiving stolen property contrary to Section 297(1) of the Criminal Code Cap 10 Volume III Laws of The Gambia 1990.
·         PARTICULARS OF OFFENCE
·         Ensa Badjie in the year 2007 at Dippa kunda in the Republic of The Gambia within the jurisdiction of this court received Three Hundred Thousand
Dalasis from Soriba Condeh knowing same to have been obtained through
robbery and thereby committed an offence.
·         COUNT SEVEN
·         STATEMENT OF OFFENCE
·         Aiding or abetting Robbery with violence contrary to section 272 punishable under Section 273 read together with Section 23 (c) of the Criminal
Code Cap 10 Vol III Laws of The Gambia 1990.
·         PARTICULARS OF OFFENCE
·         Ensa Badjie sometime in the year 2007 at Dippa Kunda in Kanifing Municipality of The Gambia within the jurisdiction of this Honourable
court aided Soriba Condeh, Mohammed Camara (alias Langman), Ibrahima
Souma, Lamin Drammeh (alias mino) and Yusupha Baldeh to commit robbery
with violence to wit: gave the said persons his vehicle Mercedez Benz
190 for use in a robbery operation and 2,500 Dalasis to buy iron cutter
which they used to break into and rob a Lebanese supermarket at
Saffiedeen of 500, 000. 00 Dalasis and thereby committed an offence.

·         STATEMENT OF OFFENCE
·         Conspiracy to commit felony Contrary to Section 368 of the Criminal Code Cap 10 Vol III Laws of The Gambia 1990.
·         PARTICULARS OF OFFENCE
·         Ensa Badjie sometime in the year 2007 at Dippa kunda and other places in the Republic of The Gambia within the jurisdiction of this Honourable court
conspired with Soriba Condeh, Mohammed Camara (alias Langman), Ibrahima
Souma, Lamin Drammeh (alias mino) Saleiu Baldeh and Ebrima Camara to
break into and rob Trust Bank Ltd at Latrikunda by buffer zone and
thereby committed an offence.

·         STATEMENT OF OFFENCE
·         Robbery with violence contrary to section 272 and Punishable under Section 273 read together with Section 23 (d) of the Criminal Code Cap 10 Volume
Ill Laws of The Gambia 1990.
·         PARTICULARS OF OFFENCE
·         Ensa Badjie in the year 2007 at Dippa kunda and other places in the Gambia within the jurisdiction of this Honourable Court did commit an offence
to wit: procured Soriba Condeh, Mohammed Camara (alias Langman),
Ibrahima Souma, Lamin Drammeh (alias mino) Saleiu Baldeh and Ebrima
Camara to break into and rob Trust Bank Ltd at

·         Conspiracy to commit misdemeanor contrary to section 369 of the Criminal Code Cap 10 Volume Ill Laws of The Gambia 1990.
·         PARTICULARS OF OFFENCE
·         Ensa Badjie and Omar in the year 2007 at Serekunda and other places in the Gambia within the jurisdiction of this Honourable Court being employed
in the public service as police officers conspired among themselves to
commit misdemeanor to wit: to aid Soriba Condeh and other prisoners
remanded at Mile II Central prison to escape from lawful custody and
thereby committed an offence.
·         COUNT ELEVEN
·         STATEMENT OF OFFENCE
·         Aiding prisoner to escape contrary to section 109 (a) of the Criminal Code Cap 10 Volume Ill Laws of The Gambia 1990.
·         PARTICULARS OF OFFENCE
·         Ensa Badjie and Omar in the year 2007 at Serekunda in the Gambia within the jurisdiction of this Honourable Court being employed in the public
service as police officers aided Soriba Condeh and other prisoners
remanded at Mile II Central prison to escape from lawful custody by
instructing Essa Keita and Modou Jatta to collect the said Soriba
Condeh and other prisoners from Mile II central prison to Kanifing and
Bundung Magistrate's Court without the usual PIU escort resulting in
the escape of the said prisoners and thereby committed an offence.
·         COUNT TWELVE
·         STATEMENT OF OFFENCE
·         Official corruption contrary to Section 86(a) of the Criminal Code Cap 10 Laws of the Gambia 1990.
·         PARTICULARS OF OFFENCE
·         Ensa Badjie sometime in the year 2007 at Dippa Kunda in the Kanifing municipality of The Gambia within the jurisdiction of this Honourable
court being employed in the public service as a police officer
corruptly received the sum of fifteen thousand Dalasis from Soriba
Condeh in order to terminate a robbery charge alleged against one
Saleiu Baldeh and thereby committed an offence.
·         COUNT THIRTEEN
·         STATEMENT OF OFFENCE
·         Official corruption contrary to Section 86(a) of the Criminal Code Cap 10 Volume Ill Laws of the Gambia 1990
·         PARTICULARS OF OFFENCE
·         Omar Jahateh sometime in the year 2007 at Bakoteh in the Kanifing municipality of The Gambia within the jurisdiction of this Honourable
court being employed in the Public service as a police officer
corruptly received the sum of One Thousand Five Hundred Dalasis from
Soriba Condeh and Mary (alias Joto Fatou Mendy) on account of which he
caused one Saleiu Baldeh, a robbery suspect to be released on bail and
thereby committed an offence.
·         COUNT FOURTEEN
·         STATEMENT OF OFFENCE
·         Conspiracy to defeat justice and interference with witnesses contrary to Section 102(b) of the Penal Code Cap 10 Vol. III Laws of The Gambia 1990.
·         PARTICULARS OF OFFENCE
·         CSP Ali Ceesay, on or about the 6th day of May 2010 at Mile II central prison in the Republic of The Gambia within the jurisdiction of this
court being a prison officer and in order to obstruct the course of
justice dissuaded Soriba Conteh from appearing in the court to give
evidence of what he knows concerning this case by threatening to
permanently lock him in cell if he appears in court and give evidence
against Essa Badjie and thereby committed an offence.
·         COUNT FIFTEEN
·         STATEMENT OF OFFENCE
·         Deceiving witnesses contrary to Section 100 of the Criminal Code Cap 10 Vol. III Laws of The Gambia 1990.
·         PARTICULARS OF OFFENCE
·         CSP Ali Ceesay on or about the 6th day of May 2010 at Mile II central prison being a prison officer knowing that Soriba Condeh is called as a
witness in this case deceitfully threatened to permanently lock the
said Soriba Condeh in a cell if he gives evidence against Ensa Badjie
with the intent to affect his testimony and thereby committed an
offence.
·         COUNT SIXTEEN
·         STATEMENT OF OFFENCE
·         Offences relating to judicial proceedings contrary to Section 106(1) (f) of the Criminal Code Cap 10 Vol. III Laws of The Gambia 1990.
·         PARTICULARS OF OFFENCE
·         Ali Ceesay on or about the 6th day of May 2010 at Mile II Central prison in the Republic of The Gambia being a prison officer and knowing that
Soriba Condeh is called as a witness in this case attempted wrongfully
to influence the said Soriba Condeh by threatening to permanently lock
him in cell if he gives evidence against Ensa Badjie and thereby
committed an offence.
·         COUNT SEVENTEEN
·         STATEMENT OF OFFENCE
·         Criminal charms contrary to Section l68 (1) (a) of the Criminal Code Cap 10 Vol. III Laws of The Gambia 1990.
·         PARTICULARS OF OFFENCE
·         Kemeseng Kolley in the year 2010 at Mile II Central prison within the jurisdiction of this honorable court knowing that Ensa Badjie is an
accused person in Criminal Case Number HC/222/10/CR1086/AO and likely to be charged with other offences lent criminal charms which are pretended to possess power to prevent conviction to the said Ensa
Badjie and thereby committed an offence.
