Dutch National denies allegations of rape…


He is charged with six counts: two on rape, one on defilement, two on seduction and indecent acts by tourist Contrary to Section 121, 127 (1), 38, and 12 of the Criminal Code Caps 10 Volume 3 Laws of The Gambia, Children’s Act 2005 and the Tourism Offence Act 2003 respectively.
However, Andre Van Roy, a Dutch national, on Monday 9th May, 2011 pleaded not guilty to all the charges brought against him by the State Prosecutor M. Abdullah. He is being represented by Counsel Kebba Sanyang.
The particulars of offences indicated that Andre Van Roy in 2008 at Tintinto Village, West Coast Region of The Gambia unlawfully had carnal knowledge of a 15 year old girl without her consent and thereby committed an offence.
On count two, the particulars of offence stated that Andre Van Roy, between the years 2010 to 2011 at Tintinto Village, West Coast Region of the Republic of The Gambia, unlawfully had carnal knowledge of another under underage girl, thereby committed an offence.
The particulars on count three revealed that Andre Van Roy, between, 2008 to 2011 at Tintinto Village in the West Coast Region of The Gambia caused the seduction of a 15 year old girl and thereby committed an offence.
Count four: the particulars stated that Andre Van Roy between, 2010 to 2011 at Tintinto Village in the West Coast Region of The Republic of The Gambia caused the seduction of a15 year old girl and thereby committed an offence.
Count five also indicated that Andre Van Roy between, 2009 to 2011 at Tintinto Village in the West Coast Region of the Republic of The Gambia expose his genital organs to a 15 year old girl and thereby committed an offence.
On count six, the particulars stated that Andre Van Roy between, 2010 to 2011 at Tintinto Village in the West Coast Region, Republic of The Gambia expose his genital organs to a 15 years old girl and thereby committed an offence.
At this point, the Director of Public Prosecution, M. Abdullah applied for an adjournment in order to prepare well for the proceedings to continue in the next adjourned date, the defence counsel did not object to this.
With the consent of both counsels, the case was then adjourned till 17th May 2011 for hearing. The accused is remanded at the country’s maximum security wing, the Mile II Central Prison. Source - The Voice
