Absence of witness retards rights activists’ trial

The absence of the 9th prosecution witness in the theft case against two women rights activists, Dr. Isatou Touray and Amie Bojang Sissoho has resulted to the non-procedure of the trial on March 9, 2011.
The Executive Director and Programme Manager of the Gambia Committee Against Harmful Traditional Practices (GAMCOTRAP) are standing trial on one count of theft at the Banjul Magistrate Court presided by Magistrate Alagbe Taiwo Ade.

Prosecutor Superintendent Sainey Joof called for an adjournment on the condition that the witness (whose name was not mentioned) is not in court.
Defence Counsel Amie Bensouda opposed the prosecution’s application and urges that they close their case. As per the Criminal Procedure Code subpoenas are served through delivery and not by fax, she said in reaction to the prosecution’s notice that they served subpoenas to the witnesses to be available to give testimony.
Prosecutor Joof admitted that on next adjourn date of March 28, 2011 the Court can close the case provided that the witnesses failed to appear. Our reporter said the prosecution has a line-up of up to 30 witnesses for this case out of which only 8 have given evidence before the lower court.
